5 terrorists are to be tried in court in New York City just a few blocks from the ground zero of 9/11. They include the 9/11 mastermind Khalid Sheikh Mohammed.

Yeah, Give the terrorists constitutional rights, and a lawyer or 12. I'm sure there are lots of muslim extremists willing to give money to drag this case into the next decade. In a way, I hope they go free...

And if we don't keep the moral high ground, all we have left that we're fighting for is a sort of Westphalian Darwinism of which society can more efficiently employ force and brutality. If you want to live in a state where 'justice' is summary and arbitrary, feel free to move to Afghanistan. While you're there, find some guy with a rifle and helmet and have a conversation with someone who actually stands for American principles, rather than just talking about them on the internet so long as they don't conflict with his own interests and prejudices.

Irony. Also, you have to be kidding me? You just want to make up the rules/ laws on the spot depending on who it is? That's just sheer stupidity. |

Haven't we been over this already? The whole point of a constitution is to protect the unpopular. The more unpopular, the more constitutional protection is needed.
Can we presume that you think McVeigh also should not have been entitled to constitutional protections? Or whats-his-name, the Fort Hood guy? Or Jose Padilla?

FE, you amaze me. You have REALLY strong opinions, with things you think back up that opinion, but you really pretty much misunderstand everything about everything.

Without much searching because you aren't going to read it anyway
"In three rulings handed down Monday, the "Supremes," made clear that "enemy combatants are entitled to [have] access to US courts whether they are being held in a military brig within the US or at a terrorism prison camp" at Guantnamo Bay, Cuba, " http://www.csmonitor.com/2004/0629/dailyUpdate.html |

Nope, sorry, try again.
The constitution applies far beyond American citizens in general, of course - that much should be obvious. Some parts of the constitution are limited to citizens, but most of it applies pretty broadly.
Not to mention that the people surrounding and holding said terrorists are American citizens, and the constitution surely applies to them.
And "enemy combatant" is a convenient term - what exactly is your position on Johnny Walker Lindh? (That would be the "American Taliban," an American citizen captured in Afghanistan fighting on the wrong side)
What about Jose Padilla? (That would an American citizen, detained in Chicago as an enemy combatant, and detained without trial or charges)
There is no doubt that there is a legal gray zone here, but I would like to believe that we can all agree that the constitution in spirit requires us to be the good guys. And you can't be the good guys if you only apply rules of decency to your own people.

So the very principles that western democracy stands on should only be applied when it's convenient to the state? Bear in mind that most of the suspects in Guantanamo are there for fighting the U.S. military in an expeditionary war. By all rights they should be deemed prisoners of war, or if not treated as common criminals, but since the current conflict doesn't fit neatly within the Westphalian state system, suddenly the U.S. government decided it could make up legal statuses based on confused jurisdictions, and that fact that they can get away with it. I don't know what version of your constitution you've been reading, but I'm pretty sure the founding fathers were *against* the arbitrary exercise of power by the state. It's hideously ironic given how frequently you protest the unilateral actions of the state against individuals. Suddenly as soon as the person on the receiving end is someone you perceive as an enemy you're willing to shelve your principles? Hypocrite.
