5 terrorists are to be tried in court in New York City just a few blocks from the ground zero of 9/11. They include the 9/11 mastermind Khalid Sheikh Mohammed.

Yeah, Give the terrorists constitutional rights, and a lawyer or 12. I'm sure there are lots of muslim extremists willing to give money to drag this case into the next decade.

And if we don't keep the moral high ground, all we have left that we're fighting for is a sort of Westphalian Darwinism of which society can more efficiently employ force and brutality.

If you want to live in a state where 'justice' is summary and arbitrary, feel free to move to Afghanistan. Haven't we been over this already?  The whole point of a constitution is to protect the unpopular.  The more unpopular, the more constitutional protection is needed.
 
Can we presume that you think McVeigh also should not have been entitled to constitutional protections?  Or whats-his-name, the Fort Hood guy?  Or Jose Padilla?

Nope, sorry, try again.
 
The constitution applies far beyond American citizens in general, of course - that much should be obvious.  Some parts of the constitution are limited to citizens, but most of it applies pretty broadly.
 
Not to mention that the people surrounding and holding said terrorists are American citizens, and the constitution surely applies to them. 
 
And "enemy combatant" is a convenient term - what exactly is your position on Johnny Walker Lindh?  (That would be the "American Taliban," an American citizen captured in Afghanistan fighting on the wrong side)
 
What about Jose Padilla?  (That would an American citizen, detained in Chicago as an enemy combatant, and detained without trial or charges)
 
There is no doubt that there is a legal gray zone here, but I would like to believe that we can all agree that the constitution in spirit requires us to be the good guys.  And you can't be the good guys if you only apply rules of decency to your own people.

ok guys...I haven't followed this too closley.  But has anyone looked into if these people ARE Americain citizians?  Mose sleeper cell people are citizains if I am not mistaken.  Like I said I haven't looked into this, just seeing if anyone else has heard anything.
