Alright, I've been getting a bunch of PM's asking what happened with my Shocker, so I'm gonna tell all of you, weither you cared or not.

I was bidding on a Shocker on ebay, and lost. The next day the seller emailed me saying he'd sell it to me because the winning bidder didn't have the money to pay for it. So I emailed the winning bidder, he said he told the seller he didn't have enough for a few days, and hadn't heard from the seller since, and wasn't surprised he offered to sell it to me. So I went ahead and sent the guy $665 via Western Union like he wanted, and paid a $59 Western Union fee, putting my total up to $724. He picked up the money, emailed me saying he sent it and it'd be to me last tuesday, and I havn't heard from him since. Tuesday came and went, and I emailed him several times, getting no answer. Now I checked on ebay, and he got feedback from the high bidder saying he got the gun. I talked to the high bidder and sure enough, he has it. So I'm out $724. I'm trying to find a way to get his adress, that way I can take him to small claims court. But untill I can find that, I'm screwed. And I sold my A-5 to afford this gun, so now with the exception of my pump, I'm gunless. It really sucks....

you can not enform ebay because your biggest mistake was doing that you should of told him to re list it with a buy it now so it could be saw that you acually won it. but sence you did it out of ebay, ebay has nothing to do with it so sorry to break the news becuase ebay cant do nothing about.

I emailed ebay about it, hopefully they can help me, but they probably won't. I also emailed the guy that won it, asking him to send me the guys info. If I can get that, he's gonna find himself getting slapped with a lawsuit. I really hope the winner will cooperate.....

It seems you are up crap creek without a paddle. If you told ebay that he scammed you, they MIGHT contact the proper authorities and give you a break, but I doubt it. But this could be bad publicity for ebay. Oh, and what are the seller/buyer names.

Im no lawyer but I believe anything over $500 in stolen goods constitutes a felony. I would talk to your local police dept and see what they advise, I thinkthis is a god case of fraud. You do still have proof of payment(right?), and SAVE all of your e-mails!!!!   I think E-mailing e-bay wll be a long process, and probably useless.   Good luck and PLEASE keep us all informed

You do still have proof of payment(right?), and SAVE all of your e-mails!!!!   Not only that, but save the emails to a floppy disk, also... and photo copy any documentation or proof of payment you may have... just incase...

On another note, I hope you get your money back, even though the situation doesn't look good because you essentially made the purchase outside of ebay.

Yikes! That's one of the risks of eBay, can't tell if the person is honest.

Ebay usually helps me out when I sell/buy stuff and hit snags, last time I did it I got a response in about an hour.

If this is a felony, Ebay will be REQUIRED to give out either the IP address(es) of the people involved, or any other contact info they have (which is street address, city, state, zip, etc).

So yeah... this guy is screwed...

 

Do you live in the same state as this moron? Beacuse if you live in different states, isn't it out of the jurisdiction of one state or the other? Wouldn't that mean that the feds would have to get involved?

I think that the buyer and seller are the same person. If you look under the buyers feedback he never got any from the seller but the buyer gave some the the seller. Another way of ripping people off.

It wont let me get his info either cuz he hasnt been involved in any recent transactions. I think it means recent recent. Like yesterday recent.

    Good luck with your pursuit of this, but you will have to ask yourself; how far are you willing to go and how much are you willing to spend on lawyer fees and time invested to recoup any of your losses?

 

     Ebay WILL NOT help you.  This transaction was done outside of their normal processes and they have made it clear that they absolutely discourage this kind of thing for this very reason.

 

     Unfortunately, the reality is that Ebay will not assist you, they don’t have to.  They won’t do it to be nice, they just won’t do it.  This scam happens countless times every day, too many to ever count or track, let alone try to resolve.

 

     Another reality is that you will have to work with police and lawyers to effect any sort of resolution on this.  Again, this kind of thing goes on all the time and it is doubtful that the police will devote any significant amount of time or resources on this case.  Ask anyone who has been a victim of identity theft and you’ll see what I mean.  The same goes for any lawyers you hire.  If you decide to sue this person or otherwise prosecute, you will have to pay lawyer fees.  You could also sue for legal costs but again, the chances of getting anything back out of this are extremely slim.

This is exactly correct. EBay won't help you and will probably suspend your account in the process. Their usage agreement is explicit in this particular area since it's such a large problem.

Sorry, man, unless you want to hire a PI and all that jazz, you've pretty much just purchased an education. By all means, read through the EBay stuff on fraud and find the government link they provide for reporting stuff like this. It probably won't help you, but at least it'll be a heads up to the authorities.

Generally, lawyers are not allowed in Small Claims. But I'm sure there would be expenditures associated with tracking the guy down.

Definitely keep ALL communications and paperwork.

I agree.  I buy online occasionally, but only through a major website.  No online bidding.  I wouldn't bid at an auction, much less one that takes place online.  Granted ebay has been around a while, but that doesn't make me feel any better.

If you actually use EBay correctly, it works very well and is quite safe. Perpetrating fraud through EBay is a seriously bad idea.

But there are ways around the security, ways EBay warns you about. Truly, the poster of this thread was scammed because he wasn't careful.

i read the 5 or so feedback that the buyer had... one of the auctions he won was from a guy called 'mcpro'.... he has a paintball store on ebay, and is a trusted dealer ... that is where i got my gun from... im not sure, but i dont think the buyer was in on this, and i honestly dont thing he would have to be... the seller could have potentially scammed anyone who bid on the gun before the highest bid, saying that none of the higher bidders had their money or whatever.... i hope you can get this resolved as soon as possible

Who's to say the guy who claimed to be the seller was actually the seller? A lot of times, someone poses as the seller after the auction to scam you. I seriously doubt it was the same guy.

You can't go by EBay feedback when you buy outside of a protected EBay transaction. It doesn't mean anything.

Sandman is right, Ebay WILL NOT help out with this.  And as far as suing the seller, or whoever he is, that costs time and money to organize and follow through with. 

 

Local law enforcement is unlikely to do much besides file a report.  Believe me, there are not going to be detectives assigned to this, staking out his house.  Private investigators cost money. Lawyers cost money.  Even if you do get as far as identifying the individual and charging him with something, recouping any money will be a monumental task, even if you won any civil proceeding.  It will be years and many thousands of dollars later.  You could do it for the principle of the thing, but be prepared; doing it for that reason is great, but only if you have the funds and time to burn.   

 

Sorry to sound so negative, but this is the reality.  Chalk it up to experience and learn the lesson from it.  Hopefully, you will have helped to prevent it from happening to someone else, based on the information posted here.

Uhhh... If you're selecting COUNT(), wouldn't you get a return value of 0 instead of a '[0 Rows Returned]' message?

That syntax is a little different from the T-SQL I'm accustomed to (guessing it's Oracle), but I'm thinking COUNT() works basically the same.

Nope, didn't work out this time either. I was about to pay, when the seller emailed me saying he alreadu sold it. So I lose out again. I'm having crappy luck trying to get a hold of a Shocker....

^^^I've got money in my savings, that's where the first $700 came from, now I'll just have more to pay back than expected.

New news on the scam, I got an email from the seller today from a different email adress, he says he has no clue what I'm talking about. Either he's playing stupid, or more likely, it was someone different that scammed me.
