and fail. to patent something, one must invent it. i don't think anyone invented breathing, it just happened. they figured "oh garbage i appear to be dying, maybe i'll start breathing" and so it was. now we breathe so much its just second nature to us. we don't even think of breathing, we just do it. and for all of those people saying "i suck at multi tasking" well, i've got news for you. you're multi tasking right now. you are reading this post, and you're breathing. and most likely your fingers will be typing soon in reply to my post, breathing and seeing will be done at the same time. instantaneously(sp) you have multi-tasked.

I don't know if you can patent an action. Even if you could, breathing would probably be Public Domain or whatever it's called.
On topic, it seems like that's kind of a sleazy patent, considering that it's such an obvious interface. If I had created a digital music player in 1998, that would probably be the basis of my browsing interface.
