Me and two friends did some stuff to the schools most hated teacher this summer. Now he is threatening to take it to court but, isn't sure what he wants to do yet. Well, actually we really did nothing. I assume the cops wrote the reports to shut him up, me and one friend went up and requested copies of the reports as teacher said he wants one, we didn't know they cost $ so screw him we got our own. for now, gotta wait for them to get them in though.

First report : Friend was driving (kid with Ex cop car) got on it in front of his house, it threw some gravel. He called the cops and blah blah blah, stupid.

Second Report: Other friend drove buy, clipped his garbage can, it fell over and he called the cops for that. He told us his neighbor was pointing a gun at us, lmao go for it.

Also, when I tried to get an estimate of the report cost she told me it depends on the length of the report, she asked what it was for and I only said we knocked a garbage can over and she was just laughing. She thought it was funny a person took the time to call the cops because their can got knocked over.

So my question, do the reports expire, like. After a certain date is he not able to use them against us ? Also, since I wasn't driving and everything was driving related, am I free to go or does that stupid, you're a passenger thing count still ?

So that does still count ? Even though everything was driver related, nobody exited the vehicle, we all still get it ? I'd tell him to go  himself but I don't want to have him come down hard on my friends who were driving.

It has been my experience that they don't expire.  That said, if your explanations of what happened are fairly accurate, I don't see that there is a lot he can take you to court for.

I would however give serious thought to finding smarter friends to hang out with.

The guys such an ass, full of empty promises, lies to my parents, and my friends parents right to their face. He should not be working his job, he thinks he is better than everyone, he just has that mentality I guess.

Also, he even said, "It's pretty bad my my 3 best students do this" Yea, your 3 best/hardest working students just did that, take a freaking hint. He's been trying to hide his home address for so long.

Also, my explanations are accurate, well, first one, friend back up in his driveway to turn around, but tires didn't spin until he was on the dirt part of the road, and, second time my friends truck tires are bald so when he turned around and backed up they squawked a little but nothing major, then he clipped the can on the way out.

What all do you think the most he could do is ?

A report is just a report.  A piece of paper.  It doesn't "expire".  Police departments have document disposal policies, but my suspicion is that they basically keep everything forever.

But that's the wrong question.  The correct question is what the statute of limitations is.

In your case, there are two - criminal and civil.  For a civil torts claim, the statute of limitation is typically two years.  For criminal matters it varies, but certainly more than two years.

If criminal charges are to be brought, they can probably be brought for a long time.  If the guy wants to sue, he probably has a couple of years to do so.

Probably not, based on what you are describing.

And I agree that intentional infliction of emotional distress is the favorite tool of every tool, and is way overused - certainly over-threatened.

This is exactly the type of thing that it is intended to cover, though.  A pattern of outrageous behavior specifically intended to upset him - pretty much fits the bill.  Any lawsuit here would certainly include that claim, if only for the open-endedness of it.

Well technically, today when he talked to me he asked me if I knew why he pulled me out of class and I said "Yea, I know, I'm not gonna sit here and lie to you" But he never ever once mentioned anything that happened, just gave me the paper, told me to go get a copy of the reports.

Lets say it goes to court, should I deny it ?

With the report, it's just going to be hearsay. It's dude's word against yours. It wouldn't stand up in court, but none the less, it would be mightily inconvenient to have to go through all of that.

Mini mp3 recorders are nice. Sometimes having one always paused in record mode more than makes up for the batteries. You never know when someone will threaten, curse or make some off color remark that they will truly regret. Of course this only works if you're smart enough to always choose your words wisely and remember to push record before they start.

It varies by state, but most states say this. One person needs to know the conversation is being recorded. Recording let's say your mom and dad without them knowing is against the law.

I'm not sure if he's a minor, but given that he's in
high school and also acts like an idiot in his spare
time, it's a fair question...

I am a minor, I assumed that could help me. And stop telling me to apologize, we tried that, he also won't tell us what he is going to do. I also have him first and second hour (block class) for metals, he is going out of his way to be an ass to us.

While I am no Rambino, and I'm not certain on Canada's laws, I believe the parents are the ones who must have the civil suit filed against them since they are liable for their kids actions.

In the US, minors "above the age of reason" (usually around 7 years of age) are generally liable for torts.  The age of the defendant may be taken into consideration, but being 17 does not get you off the hook.

In some states, the parents may also be liable for some torts committed by the children.  Mostly not, though.

Minors cannot be civilly liable for breach of contract, as minors cannot enter into contracts and those contracts are therefore unenforceable.

Realistically, either the police or a lawyer will
probably tell him this is pointless to pursue and it
will blow over, but don't give him any admissions he
could use in court.

Yeah, I understand acting like a child on here as it doesn't go any further than the internet but if you are seriously considering making him a tiarra, you are just throwing feul on the fire. As much as everyone else has said it, you REALLY need to do everything you can to make this easier on yourself. While in class, don't draw unecessary attention to yourself. Don't hold a grudge against him for whatever reason because after all, it's just high school and in the end this is just a REALLY stupid story you will sadly be able to pass on to children. Treat it like basic training for the military, keep your head down and your mouth shut and you'll make it out just fine. Otherwise you are just asking for a lengthy and stupid back-and-forth with the police/his lawyer that will ultimately lead to nothing accept premature balding patterns due to the stress it has inflicted on you.

He's not being nice at all, he's being ass and holding this against us and crap during school. He has always been a princess, he's a damn germaphobe and wants to teach a shop class. He won't let us use half the power tools because the small dust particles make his skin dry, it's a metal shop, deal with it.

If you did this at my house, I would first call your parents, then the cops.  I would suggest to them that perhaps your truck ought to be impounded for having been used in a crime.  Then I would take pictures and sue you the next day.  You would be out thousands in attorneys fees within a month.

Then I would talk to the principal at school, and your other teachers.  Then I would go to Google and look for clues to help me think of something else.

I am vindictive.  He is being nice.  "Holding it against you" isn't being an ass when you were the ones committing the crime.

My point is that in my mind - and in his - you are no less guilty for not driving.

Well how about this, he claims to have my friends truck on video, I'm guessing of us backing up ? But I think he might be bluffing for the garbage can would be in view if the truck was, and yet he didn't know if my friend kicked the can over or hit it. Of course dumbass friend told him he got out and kicked it, I don't know why...

Should I push to see that tape ? I don't want to piss him off, but at the same time I want to see he has some proof other than some police reports. If he doesn't have video's. I'm not jumping through hoops for him anymore.

Well then one more thing. He pulled a card on me the other day saying something about the, freedom to information act or something. Basically that anyone can request information. Lets say I told people where he lived and his phone number, could I get in trouble for giving out that information ? Now don't jump to conclusions. I don't plan on doing that right now. But is it legal to since it's public information correct ?

WHY on EARTH are you making this harder on yourself? You are guilty by association, just for being physically present when the crime took place. That means that you are no less guilty than the person who was behind the wheel of whomevers truck was being used, but you may get a lesser punishment depending on the course of action your teacher pursues.

The Freedom of Information Act means that any public information (i.e. addresses/phone numbers NOT marked private by the registered owners) can be requested/obtained by just about anyone. Blue prints of a house fall under this category as well. If he has gone through lengths to make this info private (meaning you can't find it in the yellow pages or anywhere) then you can't just walk in to the city center and get it.

Even THINKING of giving out the info just shows that your maturity level is that of someone who shouldn't be near a power tool unless your just using it to castrate yourself. Your best bet along with all of your friends is to keep your mouths SHUT and heads DOWN through all  of this. THe bottom line is he didn't do anything like this to you besides get on your nerves for being the way he is. you and your friends are the ones who took action against him so applaud yourselves for being dumb.

What were you even doing near his house in the first place? He's probably going to nail you on Malicious Mistchief as well assuming you had no business being near his property other than being young punks.

The only reason I'm not denying it because I don't want to screw them over. The kid who has the first report ( one when we turned around and kid spun tires a little in dirt) is already pissed the kid who knocked the can over told he was there. But the other kids like well I'm not taking all the blame for everything. I'd love to tell him I'm not doing anything he says. But I'm afraid he might be able to get one of the other two to say I was there so that they don't take all the blame.

I know the night the first report was filed my friend wanted me to drive there and I told him no. Got in an argument and I was like, I'm not going to be the one who drives there.

Seriously, listen to yourself. What you did was wrong, and you're acting as if you're the victim. I can almost guarantee a sincere (sincere being the key word in this sentence) apology will get you off the hook. My bet is that he has noticed how immature the two of you are handling this situation, and he wants to use scare tactics to teach you guys a lesson (which you obviously need).

Man up, grow a pair, take responsibility for your actions, and go apologize. Offer to clean off his driveway, buy him a new trash can, whatever. Write an apology letter and ask to meet him in person to apologize.

I know I was given advice, I'm just running some ideas. And I'd happily clean his lawn or whatever. Honestly, I wish he would have us go over and do some lawn work or something. But he won't settle for that and I don't know why. And I haven't been an ass with him yet at all. So far we've been kissing ass all the way through this trying not to piss him off while we figure out what we want to do. I just don't know what to do. Apologies won't work on this guy. He just doesn't go for that. If denying it could keep us from going to court. Then I'd rather do that. As of right now, none of parents even know about any of this. He hasn't notified a single one of them. As for now he is waiting because he "doesn't want to make a bad decision while he is sick" Which for him means, I'll take as long as I can and drag this out on you guys.

So, the only way you will apologize is if he says he will not seek  charges against you? While I understand your backwards logic on, its not correct. Just man up, admit what you did was wrong and say your sorry (be sincere) Its not that wrong. If you want to be a real man, you would make it a written apology. (Wanna be lawyer side note here, he could use that as evidence against you should he still decide to seek charges)

If your so sure you did nothing wrong (or want to continue being a blow hard) let him take it to court. They will decide whether you are in the right or in the wrong.

And no not at all, I've already apologized, all 3 of us. What I've been trying to say is an apologies will not cut it with him. I asked him straight up what he wanted from me then and he refused to tell me what he expected from me. I'm wanting him to tell me what the hell he wants so we can see about working it out.

If you're retelling it accurately, it sounds like this guy is just simply vindictive. In which case, you're up a creek and may just need to ride it out. While I believe you and your friends got yourselves into this position needlessly, it's too late to worry about the hows and whys, you just need to survive it. It sounds like the most you can do now is do your best in his class, don't screw around, and for God's sake, don't pull any more "pranks" on him...

Tical : We have to comply with him, and like I said. He just has us jumping through hoops. I'd like to learn something instead of doing stupid little stuff for him because he says so.

And DeTrev : The 3 of us ARE his best students, we always have been and we still are. Kids do so much worse to him. He kills any motivation to excel in his class. now when he asks the class and question, we'll wait. Nobody answers, we will say the correct answer loud and clear, he just ignores us then goes on to tell the class. Yet if we do one little thing wrong, the entire class is going to hear about it. And he has done this to kids in the past. I'd almost say he is passive agressive.
