I am a rather lazy person, so I will ask the question. And I DEMAND answers

Marijuana is classified as a schedule I drug. Meaning it has no medicinal purposes etc etc. Now my question is.... How can California "legalize" marijuana for medicinal use, seeing under (federal) law, it is classified as a schedule I drug?

Federal law trumps all state laws correct? Does the DEA not care about these "medicinal clinics"?

If someone could dig up a loophole in the federal law, that would we greatly appreciated. Thank you.

Also, California state police don't enforce marijuana laws, but FEDERAL officers do enforce them.

Well, federal classification is actually incorrect about it's no medicinal purposes claim.

And also, occasionally DEA feds raid a few clinics, but as to why they don't shut the whole thing down, I'm as curious as you are.

I'm not sure how the DEA decides which clubs to raid, but it happens. They make a huge scene too. Bust through the door, guns drawn, etc. They raided one of my favorite clubs last year :(

However, the interaction of the U.S. Federalist system of government is not that simple. Proposition 215 has been through the Federal Court systems multiple times and never been struck down.

Yeah, walk in and say we're shutting this place down. It's a damn dispensary. Everyone working in them is too high to realize what's going on. It's not a drug house, its a pharmacy.

There is a ballot question this year about decriminalization. MJ offenses would not count on the state's criminal record checks, and getting caught with <1oz(of either weed or THC pills, that's a crapload of THC) would result in a $100 fine. However, a positive drug test would also count as possession. Currently, 1st offenders are typically not charged in this state, just put on probation. I know it would certainly bring in revenue to the state, but other than that, I think it's partly a ploy to assure that democrats and young people show up to vote much like the anti-gay marrige initiatives were o encourage republicains to show. The positive test as posession thing freaks me out a little. If I'm in a car that's getting hotboxed, I'd legally be in posession of canibis for a month.

Assuming you're saying you weren't smoking and would
test positive for THC,
that's not how it works.

peebee, I agree. Prohibition was/is a horrible way to "combat the drug menace." It has wasted billions of dollars and obviously isn't working. It would be much better to legalize and throw an age restriction on it like tobacco.

Also /weed/ would be a much better place to discuss this topic.
